Lawyers can usually provide the client with a set fee for a simple divorce. A simple divorce is precisely that—simple. Gone are the days when one had to find fault or prove blameworthy conduct on the part of one of the spouses. We have ‘no fault’ divorce in Canada: being irreconcilably separated for at least one year is the only necessary reason to obtain a divorce.

Our fee for preparing a simple divorce is $600.00. There are also filing fees (i.e. money that one has to pay the government) amounting to $467.00. In total, if no complications arise, a divorce will cost between $1,100.00-$1,200.00, depending on the amount of disbursements, and factoring in the H.S.T.

How long does the divorce process take?
Barring any unforeseen complications, the process should take approximately three months.

I have to deal with ‘corollary’ issues, but I would like to proceed with a divorce and deal with these other issues later. Is this possible?
It depends on the issue. One can deal with issues of property division and spousal support post-divorce. Child support, however, is a different story: generally, child support needs to be addressed prior to seeking and obtaining a divorce. Under the Divorce Act, the Court is obliged to ensure that ‘proper financial arrangements’ are in place for the children prior to granting a divorce.
